Earlier this month, Bragg’s office offered Trump the opportunity to testify before the grand jury, a clear signal that an indictment was forthcoming. However, Trump declined the invitation. According to Fox News, Manhattan prosecutors requested a meeting with law enforcement to discuss the logistics surrounding the possible indictment. The following morning, Trump posted on Truth Social that he would be arrested in the coming days.

The United States has never before seen a former president face criminal prosecution, making Trump’s indictment unprecedented. In October of 2016, just prior to the general election, Trump’s former attorney and fixer Michael Cohen paid Daniels $130,000 to sign a non-disclosure agreement, which prevented her from sharing details of the alleged affair with the media. The payment was made to prevent another sexual scandal from surfacing during the final stages of a campaign that was still dealing with the fallout from the Access Hollywood tape. Despite its explicit goal of supporting Trump’s 2016 presidential campaign, the payment was not disclosed as a campaign contribution.
